Product Licence Agreement

1. Products Covered

This Agreement applies to every PlatformClouds Product now available or released in the future, including but not limited to:

• Software applications
• Website applications
• Desktop software
• Mobile applications
• WordPress plugins
• Web engines
• Performance engines
• SEO engines
• Image optimisation engines
• Security engines
• Monitoring engines
• API products
• Engineering blueprint packages
• Architectural blueprint packages
• Mechanical engineering systems
• Structural engineering systems
• Machine concepts
• CAD documentation
• Technical documentation
• Engineering reports
• Digital downloads
• PDF documentation
• Templates
• Design assets
• Educational resources
• Documentation
• Any future PlatformClouds Product.

2. License Tiers

PlatformClouds Products may be offered under one or more license tiers including:

• Digital Edition
• Commercial License
• Enterprise License
• Any future license tiers introduced by Alpha & Omega Limited.

The rights granted under your purchase are determined by the specific license tier purchased. Product descriptions or individual product pages may grant additional rights beyond this Agreement.

3. License Grant

Subject to full payment and continued compliance with this Agreement, Alpha & Omega Limited grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the purchased Product in accordance with the purchased license tier.

This Agreement grants a license to use the Product only. No ownership of any Product or intellectual property is transferred.

4. Intellectual Property Ownership

All PlatformClouds Products remain the exclusive intellectual property of Alpha & Omega Limited.

This includes, without limitation:

• Software source code
• Compiled software
• Algorithms
• Engineering concepts
• Machine designs
• Architectural systems
• Blueprints
• CAD files
• Illustrations
• 3D renders
• Documentation
• Logos
• Graphics
• Brand names
• Trademarks
• Copyrights
• Trade secrets
• Patents where applicable.

5. Permitted Uses

• Install and use purchased Products.
• Use Products within the rights granted by the purchased license tier.
• Use Products for internal business purposes where permitted.
• Perform engineering analysis and research.
• Create simulations.
• Use documentation for study and reference.

6. Restrictions

Unless expressly authorised in writing, you may not:

• Redistribute Products.
• Resell Products.
• Share downloads.
• Upload Products to file-sharing websites.
• Transfer licenses.
• Sub-license Products.
• Claim ownership.
• Remove copyright notices.
• Copy Products for unauthorised commercial resale.
• Create competing commercial products by copying substantial portions of PlatformClouds Products.

7. Engineering Products

Engineering and architectural Products are supplied as conceptual engineering, design and research documentation. They are not construction-ready, manufacturing-ready, or certified engineering documentation unless explicitly stated. Independent engineering review, verification, testing, certification and regulatory approval remain the responsibility of the end user.

8. Software Products

Software Products are provided "AS IS" and are intended for installation within supported environments as described in each Product documentation. Compatibility with every operating system, hosting provider, server, browser, plugin, theme or third-party application cannot be guaranteed.

9. Updates

Product updates, patches, documentation revisions and improvements may be provided at the discretion of Alpha & Omega Limited unless otherwise stated.

10. Termination

Violation of this Agreement may result in immediate termination of your license. Upon termination you must immediately discontinue use of the affected Product.

11. Warranty Disclaimer

All Products are supplied "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory.

12. Limitation of Liability

To the fullest extent permitted by law, Alpha & Omega Limited shall not be liable for indirect, incidental, special, consequential or punitive damages arising from the use, misuse or inability to use any Product.

13. Governing Law

This Agreement is governed by the laws of New Zealand.

14. Entire Agreement

This Agreement, together with the PlatformClouds Terms & Conditions, Privacy Policy and Refund Policy, constitutes the entire agreement governing all PlatformClouds Products unless a specific Product includes additional license terms.

15. Patent Prohibition & Intellectual Property Protection

All PlatformClouds Engineering Products — including but not limited to conceptual engineering systems, architectural systems, skyscraper systems, turbine generators, magnetic rotor pumps, compressed‑air generators, mechanical systems, structural systems, CAD‑ready documentation, blueprint packages, diagrams, schematics and any derivative works — are protected under strict non‑patent licensing.

No purchaser, user, organisation or third party is permitted to file, attempt to file, assist in filing, or participate in any patent application, provisional patent, utility model, design patent, innovation patent or any other intellectual property registration based on any PlatformClouds Product or any portion, adaptation, modification or derivative thereof.

This prohibition applies fully and without limitation to:

• Direct copies of PlatformClouds Products.
• Modified versions, adaptations or alterations.
• CAD conversions, CAD redraws or CAD reconstructions.
• Engineering prototypes or physical implementations.
• Construction-ready drawings derived from conceptual documentation.
• Mechanical, architectural or structural variations.
• Any system, machine, device or structure inspired by or based on PlatformClouds concepts.
• Reverse-engineered versions created for patent purposes.

All patent rights, intellectual property rights, engineering concepts, architectural systems, mechanical systems, structural systems, blueprint designs, CAD parameters and technical documentation remain the exclusive property of Alpha & Omega Limited.

Purchasers receive a license to use the Product only. No ownership, patent rights, IP rights, construction rights or derivative rights are transferred under any license tier unless explicitly stated.

Any attempt to patent, register, claim ownership of, or assert intellectual property rights over any PlatformClouds Product or derivative work constitutes a material breach of this Agreement and will result in immediate termination of all licenses, without refund, and may result in legal action.
